Providing Community Health To Those Most In Need.

All individuals participating in an Onda Health medical mission must agree to the Code of Conduct policy.
1. All individuals must comply with environmental, safety, and fair dealing laws. We expect all team members to be ethical and responsible when interacting with patients, community members, partners, and other team members (volunteers and staff). Any ethical concerns you witness should be immediately addressed with the team leader or medical director.
2. All individuals should respect their fellow team members. Onda Health will not tolerate discriminatory behavior, harassment, or victimization. All team members should bring an open mind and a willingness to learn.
3. Interactions with other team members and volunteers should be conducted with the highest professional standard. No favors, special treatment, or material requests should be made at any time. It is prohibited to take medical supplies and medications for personal reasons without permission from the team leader or medical director. Any individual needing medication must first be seen by a licensed clinician.
4. Team assignments should be accepted based first and foremost on the needs of the patients and performed with a high regard for commitment and responsibility. All individuals will be treated with dignity and respect. We will embrace cultural differences and customs and avoid disruptive behavior like profanity or other abusive language.
5. We respect others' right to confidentiality and privacy. No photos or recordings will be captured or shared without consent, and we will not proselytize or pressure anyone to accept specific political, cultural, or religious beliefs.
6. All volunteers will refrain from any conduct that would be detrimental to the team, Onda Health, and its standing with other individuals, community partners, and government agencies. All team members are expected to:
a. Not possess, use, or be under the influence of illegal drugs or alcohol at any time for the duration of the trip (both on-site or after clinic hours).
b. Wear culturally appropriate attire. Clothing (even after clinic hours) should be modest and free from offensive language or graphics.
c. Follow safe working practices, using appropriate safety equipment, reporting incidents, injuries, and unsafe situations as soon as possible.

Failure to comply with the above standards of conduct may result in the individual being immediately dismissed from the team and sent home at their own expense.

GENERAL RELEASE, WAIVER, INDEMNIFICATION, AND ASSUMPTION OF RISK AGREEMENT
WARNING: THIS GENERAL RELEASE, WAIVER, INDEMNIFICATION AND ASSUMPTION OF RISK AGREEMENT SHOULD BE REVIEWED BY AN ATTORNEY PRIOR TO SIGNING. IT IS A LEGAL DOCUMENT THAT AFFECTS YOUR LEGAL RIGHTS, BOTH NOW AND IN THE FUTURE. PLEASE CONSULT AN ATTORNEY PRIOR TO AGREEING TO THE TERMS AND CONDITIONS.

I hereby acknowledge that I desire, of my own free will, to serve as a volunteer for Onda Health, Inc., a Texas non-profit corporation (hereinafter “Onda Health”). I am aware and acknowledge that the volunteer work may involve hazards to my health and/or life, including a risk of injury, illness, and potentially death. I hereby acknowledge that there are dangers inherent in travel to, within, and from foreign countries, including but not limited to traveling in light airplanes, the unavailability of adequate medical facilities, being within and subject to the laws of a foreign country with little to no methods to contact home, the chance for crime, terrorism, violence, political unrest or guerrilla activity, as well as unsanitary health conditions and exposure to certain disease, including but not limited to hepatitis, malaria, cholera, and polio.

I HEREBY PERSONALLY ASSUME ALL OF THE ABOVE STATED RISKS, AND ALL OTHER RISKS ASSOCIATED WITH MY PARTICIPATION AS A VOLUNTEER FOR ONDA HEALTH WHETHER KNOWN OR UNKNOWN.

AS CONSIDERATION FOR BEING ALLOWED BY ONDA HEALTH TO PARTICIPATE IN ITS NON-PROFIT WORK, I HEREBY RELEASE AND FOREVER DISCHARGE ONDA HEALTH, ITS DIRECTORS, OFFICERS, AGENTS, EMPLOYEES, VOLUNTEERS, ATTORNEYS, REPRESENTATIVES, ASSIGNS AND AFFILIATES FROM ANY AND ALL CLAIMS AND DEMANDS OF WHATEVER KIND OR NATURE, WHETHER KNOWN OR UNKNOWN, THAT ARISE OUT OF OR ARE CONNECTED IN ANY WAY WHATSOEVER WITH MY VOLUNTARY PARTICIPATION IN THE WORK OF ONDA HEALTH.

I ALSO HEREBY RELEASE AND FOREVER DISCHARGE ONDA HEALTH, ITS DIRECTORS, OFFICERS, AGENTS, EMPLOYEES, VOLUNTEERS, ATTORNEYS, REPRESENTATIVES, ASSIGNS, AND AFFILIATES FOR ANY AND ALL CLAIMS AND DEMANDS OF WHATEVER KIND OF NATURE, KNOWN OR UNKNOWN, ARISING FROM OR CONNECTED IN ANY WAY WHATSOEVER WITH ANY FIRST AID, MEDICAL TREATMENT OR SERVICES RENDERED TO OR BY ME DURING MY PARTICIPATION IN ANY WAY RELATED TO ONDA HEALTH WORK. FURTHER, I AGREE TO FULLY AND COMPLETELY INDEMNIFY AND HOLD HARMLESS ONDA HEALTH DIRECTORS, OFFICERS, AGENTS, EMPLOYEES, VOLUNTEERS, ATTORNEYS, REPRESENTATIVES, ASSIGNS, AND AFFILIATES, WHETHER SPECIFICALLY NAMED HEREIN OR NOT, ALL AND EACH OF THEM, OF AND FROM ALL FUTURE CLAIMS, DEMANDS, ACTIONS, OR CAUSES OF ACTION, INCLUDING BUT NOT LIMITED TO LEGAL FEES, COURTS COSTS, AND REASONABLE AND NECESSARY EXPENSES, COST FOR INVESTIGATION AND PREPARATION OF DEFENSE AND JUDGMENTS, THAT MIGHT EVER BE ASSERTED AGAINST ONDA HEALTH, AS A RESULT OF MY VOLUNTEER WORK FOR ONDA HEALTH.

I hereby acknowledge and agree that I am not an employee of Onda Health and that my position is as a volunteer. I acknowledge and agree that Onda Health is under no obligation to provide, and does not provide, insurance of any kind, including health insurance, malpractice insurance, workers compensation insurance, or any other benefits of any kind, besides in-country travel insurance.

During my work as a volunteer, I hereby agree to immediately notify the team leader(s) of Onda Health of my need for medical attention and/or medical treatment. I hereby permit the team leader(s) of Onda Health to secure whatever is necessary in order for me to receive medical attention and/or medical treatment, including but not limited to a hospital, doctor, and/or anesthesiologist for emergency surgery and/or treatment. I HEREBY ACKNOWLEDGE THAT THE SUPPLIES, PROFESSIONALS, AND HOSPITAL MAY NOT BE EASILY ACCESSIBLE, THEREFORE LIMITING THE QUALITY OF CARE I MAY RECEIVE. FURTHER, I HEREBY ACKNOWLEDGE THAT I WILL BE RESPONSIBLE FOR ALL COSTS AND EXPENSES INCURRED UNDER THIS PARAGRAPH.

Furthermore, should Onda Health pay for such costs and expenses, I hereby agree to reimburse Onda Health in full, within Ninety (90) days of my return to the United States. Further, I hereby acknowledge that the standard of care available in such foreign country may not be the same as the standard of care one would receive in the United States. Due to the lack of quality medicine, Onda Health HIGHLY recommends that you bring any medication that you require and/or think you will need on the trip. If Onda Health does provide any medication, you will be taking such medication at your own risk and on your own advice.

I hereby acknowledge that this agreement is a binding legal document that affects my legal rights and remedies. I acknowledge that this agreement binds not only me but my spouse, children, heirs, representatives, distributees, guardians, and assigns. I acknowledge and agree that this agreement is intended to be interpreted as broadly and inclusively as permitted under the laws for the State of Texas. If legal proceedings are filed, I acknowledge such proceedings will be tried only in the State of Texas, and any proceedings will be brought and conducted only the District Court of the State of Texas in and for the County of Lubbock. By my signature below, I hereby agree to be subject to personal jurisdiction and venue of the State of Texas, County of Lubbock, and waive any right I may have to commence any litigation, administrative actions, or arbitration other than the District Court of the State of Texas in and for the County of Lubbock.

I acknowledge and agree that if any clause, sentence, or provision of this agreement shall be held to be invalid or unenforceable by any court of competent jurisdiction, the unenforceability or invalidity of such clause, sentence, or provision shall not affect the validity or enforceability of the remaining terms. I acknowledge and agree that the terms of the agreement are contractual and are conditions precedent to my participation in the work of Onda Health and not mere recitals.

I HAVE CAREFULLY READ THIS AGREEMENT AND FULLY ACKNOWLEDGE THE CONTENTS. I HAVE HAD THE OPPORTUNITY FOR LEGAL REVIEW OF THIS BINDING DOCUMENT AND CHOOSE TO AGREE TO THE TERMS AND CONDITIONS VOLUNTARILY.
